Terms of Service

1. About these Terms
These Terms of Service (the “Terms”) govern your use of the website at complyora.com and the services offered there, including the U.S. Visa Photo and U.K. Visa Photo tools (together, the “Service”). For the purposes of these Terms, a “User” is any person who visits or uses the Service through a web browser, and “Product” means the digital visa-compliant photo you purchase through the Service.
The Service is operated by Complyora (“we”, “us”, “our”), an independent photo compliance tool. We are not affiliated with the U.S. Department of State, His Majesty’s Passport Office, or any government agency. Browsing complyora.com and uploading a photo for a pre-payment check is free of charge; charges apply only to the purchase of a Product.
2. Using the Service
You are responsible for the photo you upload and for verifying that it is of yourself (or that the person depicted has authorised you to upload it on their behalf). You agree to use the Service only for lawful purposes and to comply with applicable law, including the consumer-protection rules described in section 11 below.
To use the Service you need a modern web browser with cookies enabled. We do not currently offer a dedicated mobile application.
Acceptable use:
- One photo per purchase. Bulk or automated submissions are not allowed.
- Upload only a photo of yourself, or of a person who has authorised you to do so.
- No copyrighted, illegal, or inappropriate content.
- No attempts to circumvent rate limits, payment, or our compliance checks.
3. Our responsibilities and limits
We undertake to deliver a Product that meets the technical visa-photo requirements we publish on the Service for the document type you selected (U.S. visa photo or U.K. visa photo).
We are not responsible for the failure to perform the Service when that failure is caused by circumstances outside our control, including but not limited to acts or omissions of telecommunications carriers, payment processors, hosting providers, or government authorities.
We do not guarantee acceptance of any Product by any embassy, consulate, government department, or other reviewing authority. Final acceptance of a visa photo is at the discretion of that authority and is outside our control. Anything to the contrary would constitute a misleading representation under section 52 of the federal Competition Act (R.S.C. 1985, c. C-34) and is not made.
4. How the agreement is formed
By using the Service you accept these Terms. An electronic agreement formed by your use of the Service (including completing a purchase) is enforceable under section 19 of the Ontario Electronic Commerce Act, 2000 (S.O. 2000, c. 17). If you do not accept these Terms, do not use the Service.
5. Buying a photo
After uploading a photo and passing the free pre-check, you can purchase a Product by completing checkout. Prices shown at checkout are in the currency stated there and include any applicable tax; we use tax-inclusive pricing so the amount shown is the amount you pay.
Payment is processed by a third-party payment provider. Your card details are entered on the provider’s own secure page and held by them; we never see or store your card number, CVV, or expiry.
We use an authorize-then-capture model: your card is authorised at checkout (a temporary hold is placed) but only captured when we successfully deliver a Product that passes our compliance check. If we cannot deliver a compliant Product, the authorisation is cancelled and your card is never charged. After successful capture, the Product is made available for download and emailed to the address you provided.
6. Disclosure under Ontario consumer law
These Terms, together with the Privacy Policy and the Refund Policy, provide the disclosure required by section 38 of the Ontario Consumer Protection Act, 2002 (S.O. 2002, c. 30, Schedule A) for internet agreements. Because that disclosure has been made available to you before purchase, the seven-day cancellation right set out in section 40(1) of the Act does not apply by default. Refunds are dealt with in section 8 below.
7. Complaints and resolution
Complaints related to the Service can be submitted by email to [email protected]. Please include your order number (shown at the top of your download page and in your order email) and a description of the issue.
We acknowledge complaints within 14 days of receipt. If we are unable to resolve a complaint to your satisfaction, you may also raise it with Consumer Protection Ontario (the consumer-protection authority for the province) or with another competent body for your jurisdiction.
8. Refunds
Because we use authorize-then-capture (see section 5), most failures do not require a refund — your card is simply never charged. If we do issue a refund for a Product, the refund will be made to the same payment method you used to pay for it. 9. Limitation of liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us for the Product giving rise to the claim. The Service is provided “as is” and we make no warranties beyond those stated in these Terms or required by law. Nothing in this section limits any liability that cannot be excluded under the Ontario Consumer Protection Act, 2002.

11. Governing law and changes to these Terms
These Terms and any dispute arising under them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts of Ontario have exclusive jurisdiction. Matters not specifically addressed in these Terms are governed by applicable Ontario and federal consumer-protection law, including the Consumer Protection Act, 2002, the Electronic Commerce Act, 2000, and the federal Competition Act.
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. Material changes take effect 14 days after they are posted on the Service. Purchases made before a change takes effect are governed by the Terms in force at the time of purchase.
